The Process

The TAMA 38/2 is a process that gives you, the residents, security and peace of mind against earthquakes and safety hazards. We invite you to participate in urban renewal process with a group that has a financial strength and professional service. In the TAMA 38/2 process, we will demolish the old building and the new building will be with a rich and modern specification.

Common Terms

TAMA 38

A national plan of strengthening existing buildings against earthquakes. TAMA 38 encourages strengthening structures that was built before - 1.1.1980. TAMA 38 gives local committees the authority and discretion to add additional building rights. There are two kinds of TAMA 38: TAMA 38/1 - building additions and strengthening the current building. TAMA 38/2 - demolition the old building and rebuilding a new one.

The required majority

To get started with TAMA 38 project is possible with the signatures of 80% of the owners in the building. There is no need for the approval of all tenants.

Recalcitrant tenant

A tenant that isn't interested in TAMA 38 project. If you do not manage to reach an agreement between the parties - the Commissioner signed the agreement on behalf of the recalcitrant tenant.

Taxation

TAMA 38 project contains several types of taxes, including betterment tax, improvement tax, acquisition tax, VAT and other levies such as construction fees and more. Taxes which apply to the contractor.

Prerequisite

TAMA 38 is not valid for buildings whose height doesn't exceed to two floors and total area doesn't exceed to 400 sqm. Buildings that are not occupied most of the time, such as warehouses and Structures determined for demolition under court order.

Legal advice

Every building has the right to hire a lawyer to represent them. The funding applies on the contractor.

Inspector

Every building has the right to hire a building inspector to preserve the existence of the technical specification sections during the construction work and supervise it. The funding applies to the contractor.
